Terms & Conditions

These terms govern the software-development services provided by Bowshy, operating as Orbit.

1. Who we are

2. Services

We provide custom software design and development services, including web and mobile applications, internal tools, integrations, payment flows and related deployment and support. The specific deliverables, scope and timeline for each engagement are set out in the proposal / statement of work agreed with you before work begins.

3. Engagement, scope and change orders

Work proceeds on the scope agreed in writing. Any change to that scope is handled as a documented change order with its own estimate, which you approve before the additional work starts. We do not bill for new scope without your approval.

4. Payment terms

  • All fees are quoted and payable in Indian Rupees (INR) and billed on 40 / 40 / 20 milestones (advance, on beta delivery, and on go-live) unless otherwise agreed in writing.
  • Payments are collected securely through Razorpay (UPI, card, netbanking). Government taxes (GST) are added as applicable.
  • Third-party costs (hosting, domains, paid APIs, messaging credits) are billed at actuals.

5. Intellectual property

On receipt of full payment for a deliverable, ownership of the custom work product created for you transfers to you. We retain ownership of our pre-existing tools, libraries, frameworks and general know-how, and may reuse non-confidential techniques and components on other projects.

6. Your responsibilities

Timely delivery depends on timely input. You agree to provide the content, access, approvals and feedback we reasonably need, and to ensure you have the rights to any materials you supply to us.

7. Warranties and limitation of liability

We deliver services with reasonable skill and care. To the maximum extent permitted by law, our total liability arising out of or in connection with an engagement is limited to the fees paid by you for that engagement, and we are not liable for indirect or consequential loss.

8. Confidentiality

Each party will keep the other's non-public information confidential and use it only to perform the engagement.

9. Termination

Either party may terminate an engagement on written notice. On termination, you pay for work completed and accepted up to the termination date; refunds of amounts already paid are handled under our Refund & Cancellation Policy.

10. Governing law and disputes

These terms are governed by the laws of India. The parties will first attempt to resolve any dispute amicably; failing that, the courts at the place of our registered office have exclusive jurisdiction.

11. Changes to these terms

We may update these terms from time to time. The current version is always published on this page with its effective date.
